Important: This Privacy Policy describes how Nack Behavioral Health, LLC ("Nack," "we," "us," or "our") collects, uses, and discloses information through our website located at https://www.nackbh.com (the "Site"). It does not describe how we handle protected health information (PHI) for individuals who become clients of our intensive outpatient program (IOP). That is governed separately by our HIPAA Notice of Privacy Practices.
By using the Site, you agree to the collection and use of information as described in this Privacy Policy. If you do not agree, please do not use the Site.
1. Information We Collect
We may collect the following categories of information through the Site:
Information you provide directly. This includes information you submit through contact forms, intake or inquiry forms, newsletter sign-ups, or email, such as your name, phone number, email address, school or university, and general information about the reason for your inquiry.
Automatically collected information. When you visit the Site, we and our service providers may automatically collect certain information about your device and usage, such as IP address, browser type, operating system, referring URLs, pages viewed, and the dates/times of your visit, typically through cookies, log files, and similar technologies.

- Facilitate the intake process for prospective clients, where applicable;

- Understand aggregate trends in Site usage;
- Comply with legal obligations and protect the rights, safety, and property of Nack, our clients, and others;

We do not use information submitted through general Site contact or inquiry forms to make clinical decisions. Clinical information is collected and used separately, and with additional safeguards, once formal intake procedures begin.
3. Health Information Collected Through the Site
If you voluntarily include information about a mental health condition, diagnosis, or treatment history in a Site contact or intake form, we will treat that information as sensitive and limit its use to responding to your inquiry and facilitating intake. However, general Site contact and inquiry forms are not part of Nack's HIPAA-covered clinical recordkeeping systems and are not encrypted to the same standard as those systems. We encourage you not to submit highly sensitive clinical detail through general contact forms; instead, wait until formal intake begins, at which point information is protected under our HIPAA Notice of Privacy Practices.
4. Cookies and Tracking Technologies
The Site may use the following types of cookies and similar technologies:
- Essential cookies necessary for the Site to function properly;
- Analytics cookies that help us understand how visitors interact with the Site (e.g., Google Analytics);
- Functionality cookies that remember choices you make on the Site.
Most browsers allow you to control cookies through their settings. Disabling cookies may affect the functionality of the Site. We do not currently use cookies for third-party behavioral advertising; if this changes, we will update this Policy accordingly.

We retain information collected through the Site for as long as necessary to respond to your inquiry, fulfill the purposes described in this Policy, and comply with our legal and recordkeeping obligations. Information that becomes part of a client's clinical record is retained in accordance with applicable law and our HIPAA Notice of Privacy Practices, which generally requires longer retention periods than general Site inquiry data.
8. Your Privacy Rights
Depending on your state of residence, you may have certain rights regarding your personal information, which may include the right to:
- Know what personal information we have collected about you;
- Request deletion of personal information we have collected, subject to certain exceptions (including information that is part of a clinical or legal record);
- Correct inaccurate personal information;
- Opt out of certain uses of your information, where applicable;
- Not be discriminated against for exercising your privacy rights.
California residents may have additional rights under the California Consumer Privacy Act (CCPA), as amended, and the California Confidentiality of Medical Information Act (CMIA). 9. Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. If you believe a child under 13 has submitted personal information to us through the Site, please contact us so we can delete it.

The Site may contain links to third-party websites or services that are not owned or controlled by Nack, including insurance verification tools or external mental health resources.
